Over the course of a 33-year career, Tim has represented some of the biggest names in the franchise and restaurant industry—and also advised some of the smallest. He gained his initial franchise experience negotiating international license agreements as corporate counsel for 6000 unit franchisor Century 21® Real Estate. He then headed up the international franchise division of $2.2 billion revenue, publicly-traded Jack in the Box® Restaurants where he supervised franchise marketing and operations.

He also served as corporate counsel to the company’s purchasing, IT and marketing departments. From 2000-02 Tim was general counsel of a Silicon Valley-based pre-IPO telecommunications start-up, and also represented several other start-up and telecommunication companies.

More recently, Tim served as Senior Vice President, General Counsel & Secretary to the Coco’s® and Carrows® restaurant chains, where, among other things, he supervised real estate, risk management, human resources, franchise sales and franchise operations.

Since 2005, Tim has had a private law practice representing national and international restaurant and franchise clients, with an emphasis on franchise registration, disclosure and relationship issues.

Tim’s unique in-house background enables him to provide practical, business-oriented solutions to franchisors and franchisees. His expertise includes intellectual property licensing and trademark matters, international franchising, retail lease drafting and negotiations, franchise registration and compliance, litigation advice, and general corporate and business matters. Clientele include established franchisors, large restaurant companies, multi-unit franchisee organisations, as well as single-site retailers, and start-up franchisors.

Stewart Germann

Stewart is a Barrister and Solicitor of the High Court of New Zealand and he attended the University of Auckland. He has the qualifications of B.Com, LLB, FCIS, CFInstD and Notary Public and he specialises in franchising, licensing, sale and purchase of businesses and commercial law.

Stewart has over 40 years’ experience in franchising law and has acted for many franchisors in New Zealand and overseas. He also acts for franchisees advising them about a particular franchise and commenting on the form of franchise documents.

From 1997 to 1999 Stewart was the Chairman of the Franchise Association of New Zealand. He has spoken at franchising conferences in New Zealand, Australia and USA and is very interested in international franchising. He has also written numerous articles on franchising for New Zealand and international publications.

Stewart is a member of the International Franchise Association based at Washington DC and of the International Bar Association.

Stewart is a qualified mediator and is a member of AMINZ. He is also on the Panel of Mediators of the Franchise Association of New Zealand.

Thesis was: “Comparative study between the Hague and Hamburg Rules in the Carriage of Goods by Sea”. He was admitted to the Athens Bar in 1985 and transferred to the Piraeus Bar in 1987. He is a co-author of the section on Greek Aviation Law in Longman’s “Capital Taxes and Estate Planning in Europe”(1992) and has published an article on the “Time Bar of Claims for Contribution to General Average” (Maritime Law Review, Dec. 1991).
