Professional Biography:

With more than 25 years of experience practicing environmental, oil and gas and energy law, and a previous career as an environmental engineer and manager, Kenneth S. Komoroski has advised and represented manufacturers and distributors of a wide variety of products and services, including steel, specialty steel, wood treating, petroleum products, coke and coal tar, organic and inorganic chemicals, electric power, powdered metals, magnetic products, coatings, metal products, aluminum and oil and gas. Ken counsels these businesses on environmental compliance, permitting, land use and zoning, air issues, water usage, wastewater treatment, hazardous and solid waste issues and related litigation.

Having represented the oil and gas industry since 1990 and the shale gas industry since 2004, he has also played a significant role in the growth of the Marcellus, Utica, and Upper Devonian shale industry. Ken has read and applied in practice the myriad federal and state laws and regulations that can impact businesses, including the RCRA, CWA, CAA, TSCA and CERCLA statutes and regulations.

Ken represents businesses before environmental hearing boards (he has personally handled more than 50 such appeals) and negotiates compliance concerns with state and federal environmental agencies, sometimes with regional staff and often with the highest level positions. He also assesses and helps resolve environmental issues for buyers and sellers of industrial properties, including application and broad use of voluntary cleanup programs that provide liability relief. In handling permitting and compliance matters for his clients, Ken has worked with regulators in the US Environmental Protection Agency (EPA) headquarters and every EPA Region. He has worked with state agencies in 38 states, including Pennsylvania, West Virginia, Ohio, Maryland, New Jersey, Texas, Indiana, Illinois, Kentucky, New York, Connecticut, Colorado, California, Arkansas, North Carolina, South Carolina, Wyoming, New Mexico and Florida.

Ken is active in organizations that include the Marcellus Shale Coalition, the American Iron and Steel Institute, and the American Coke and Coal Chemicals Institute. Appointed by President George W. Bush in 2003, he served as chairman of the Ohio River Valley Water Sanitation Commission (ORSANCO), an organization that sets the water quality standards for the Ohio River. He also previously served as ORSANCO’s chair of its Pollution Control Standards committee. Ken brings on-the-ground industry experience to his practice, previously supervising air, water and waste programs at a major chemical company and also working as a production foreman at a large chemical plant where he gained invaluable, hands-on experience.

In addition he worked as a compliance specialist at a large chemical plant where he handled air, water, and waste issues, interacting directly with plant staff and federal and state regulators. Ken works hard to understand his clients and their products, operations and services.  He applies this understanding to achieve positive business results for every client.
